InclusionQuery (‘the service') is operated by InclusionQuery CIC (We,Us).
By using the service, you indicate that you accept these terms and conditions and you agree to abide by them. A user accepting these terms on behalf of a corporate entity represents that s/he has the authority to do so. If you do not agree to these terms and conditions please refrain from accessing or in any way using ‘the service'.
1. Use of the Service
Subscribers and authorised users may use ‘the service' in accordance with and subject to the terms of their subscription. ‘The service' which can be used by other users depends on their user status. Trial users may be permitted to use ‘the service' as determined by us in our sole discretion.
We may vary ‘the service' each category of trial user may access from time to time and in our sole discretion. We reserve the right to grant specific groups of users access to certain select portions of ‘the service' which may be the same as or different from the access normally given to that particular type of User.
Users may use the portions of ‘the service' they are entitled to access under their subscription for the purposes of private or business research, and in pursuance of this may:
a. Use the Analytical tools and display generated outputs on screen
b. Make printouts of generated outputs using the printing commands of the web browser, and
c. Download and store in machine readable format for the duration of their subscription any generated outputs.
Users may not:
d. Re-sell ‘the service' or any generated outputs to others;
e. Make ‘the service' or any generated outputs available on a local area network, a wide area network or any intranet or extranet. A separate multi-user subscription should be obtained for this purpose
f. Download, store, reproduce, transmit, display, copy, distribute or use ‘the service' or any generated outputs other than as permitted by section 1 above.
g. Use ‘the service' in any that may lead to the encouragement, procurement or carrying out of any criminal or unlawful activity.
h. Use ‘the service' to transfer files that contain viruses, trojans, worms or anything else that is malicious or technologically harmful or that may interfere with, interrupt or disrupt the normal operation of ‘the service'.
i. Use ‘the service' in a way to cause it to be interrupted, damaged, rendered less efficient or in a way so that the effectiveness or functionality of ‘the service' is impaired.
j. Do anything that would seek to bypass or interfere with any security features of ‘the service', or interfere with any of our servers, or networks.
k. Attempt to gain unauthorised access to any part or component of ‘the service', the server on which ‘the service' is stored or any server, computer or database connected to ‘the service'.
l. Any other use requires our prior written consent.
Passwords are for the personal use of the user to whom they were issued and may not be made available to others for the purposes of using ‘the service'. If we suspect that a password is being used by an unauthorised person, we may cancel the password.
4. Your Obligations
a. You confirm that all information and details provided by you to us (including on registration) are true, accurate and up to date in all respects at all times.
b. You will comply with the restrictions on use of ‘the service' as set out in section 2 above and as set out elsewhere in these terms and conditions.
c. You agree to indemnify us against all claims, liability, damages, losses, costs and expenses, (including legal fees), suffered by us and arising out of any breach of the terms and conditions by you or any other liabilities arising out of your use of ‘the service' or the use by any other person accessing ‘the service' using your user account.
We may suspend or terminate access to ‘the service' of any user reasonably suspected to have breached these terms and conditions, with or without notice and without further obligation. We may also terminate access of trial users for any reason, with or without notice and without further obligation.
a. Features may be added to and removed from ‘the service' without notice.
b. The features included in ‘the service' are provided for information and reference purposes only. They are not intended as a substitute for professional advice or judgement or to provide legal or other advice with respect to particular circumstances.
c. The census and population statistics used in ‘the service' are subject to periodic updates, and although every effort is made to keep the features of ‘the service' up to date, users are advised to seek independent verification or advice before relying on any piece of information in circumstances where loss or damage may result.
d. ‘The service' is provided on an ‘as is' basis and we exclude to the extent permitted by law all implied as warrantied relating to fitness for a particular purpose.
7. Intellectual Property Rights
a. All intellectual property rights and other rights in ‘the service', including without limitation, trademarks, logos, graphics, photographs, animations, signage, livery, get-up, videos, publications, reports and text (in both machine readable and printed formats) belong to 21st Light Ltd or its third party Licensors. Users and subscribers acquire no proprietary interest in ‘the service' and except as expressly permitted by these terms and conditions may not use ‘the service' in any way that infringes any intellectual property rights in them.
b. Users and subscribers may not obscure or remove any copyright notices that appear on materials printed from ‘the service'.
c. We reserve the right to take any action to prevent the unauthorised use of our intellectual property rights.
d. All third party product or company names, devices, logos, icons, graphics and designs referred to on ‘the service' are or may be trademarks of their respective owners and are exhibited in good faith and in such a manner as intended to be for the benefit of the trademark owners.
8. Limitation of Liability
a. Our total aggregate liability in connection with your use of ‘the service' (other than in the case of death or personal injury caused by our negligence) shall not exceed the amount paid or payable by the relevant subscriber or, if no payment is due, five hundred pounds (£500).
b. Our liability for interruptions to availability of ‘the service' caused by circumstances within our control shall not exceed the amount paid by the relevant subscriber for access to ‘the service'. Our only obligation in respect of interruptions caused by circumstances outside our control shall be to use all reasonable efforts to have ‘the service' reinstated.
These terms and conditions shall be interpreted in accordance with the Laws of England and any dispute shall be subject to the exclusive jurisdiction of the English Courts.
